Eligibility
There are three stages involved in obtaining a Workpermit for Canada:
1. A Valid Job Offer from an Employer in Canada.
2. LMO (Labor Market Opinion) must be completed by your sponsoring employer in Canada.
3. Work permit application through CIC (Citizenship and Immigration Canada).
LMO and HRSDC
All employers in Canada wishing to recruit an overseas national must obtain the Labor Market Option on the main applicant’s behalf before he submits his/her application with the CIC for a Canadian Work Permit. The LMO is required so that the Department of Human Resources and Social Development Canada (HRSDC) can verify the vacancy could not have been fulfilled by a Citizen of Canada.
The above also shows that the Employer has taken necessary measures to find a foreign national for a work visa only after they have processed the LMO for the candidate’s vacancy in country. This process allows the HRSDC to adhere to the protocols and limitations implemented by the Canadian government.
Dependants
As a work permit applicant you may be allowed to bring your dependents such as husband, wife, dependent children or common law partners to join you temporarily. However, if they decide to seek employment in Canada they must apply for a work visa for themselves.
Exempted Occupations
As per the Citizenship and Immigration Canada you may not need a work permit if your occupation falls under the exempted occupation categories below:
• Business visitors: you will not be required to apply for a work permit and are allowed to engage in business activities without entering the Canadian labour market.
• Foreign representatives: Diplomats and representatives of different countries or the UN. Their family members may also be allowed to work or study if they a letter of no-objection from the Department of Foreign affairs and International Trade (DFAIT)
• Military personnel: If you are a member of the armed forces from your country you can work in Canada with a movement order stating your entry as per the terms of the Visiting Forces Act.
• Foreign government officers: As Canada has exchange agreements with some countries, a foreign government official are allowed to work in Canada without a work permit. But you must bring along a formal letter from your government if you wish to work for longer than three months.
• On-campus employment for foreign Students: A fulltime foreign student is allowed to seek on-campus employment without the necessary need to apply for a work permit.
• Performing artists: Those seeking to enter Canada for a limited time and are not performing for bars or restaurants, movies, television or radio.
• Athletes and coaches: Foreign teams, athletes and coaches can play in Canada without a working permit.
• News reporters: a foreign news company employee to report news on events in Canada.
• Public speakers: Only valid for 5 days for guest, commercial or seminar speakers.
• Convention organisers: Staff organizing international meetings.
• Clergy: Entering Canada for the purpose preaching or religious lectures or providing spiritual counselling.
• Judges and referees: judges for music and dance festivals or animal shows or agricultural competitions.
• Examiners and evaluators: Professors, project supervisors or academic experts entering for research or for an academic institution don’t require a work permit.
• Expert witnesses or investigators: specialists entering Canada to provide evidence to the court or a regulatory body do not need a work permit.
• Health-Care students: foreign students entering Canada for duration of no longer than 4 months with a written approval from the regulatory board of Canada.
• Civil aviation inspector: Flight inspectors entering to check safety or operations of commercial airlines for the purpose of international flights.
• Accident or incident inspectors: Accredited representative to investigate an aviation accident or incident conducted under the Transportation Accident Investigation and Safety board Act.
• Crew members: Truck, bus drivers, ships or airline crew do not require a Workpermit to enter Canada.
• Emergency service providers: Support workers in case of natural disasters or industrial accidents with major threat to the environment are allowed to enter without a work permit.
